Welcome to this first edition of the whichfranchise.co.za newsletter. The past few weeks have been hectic but also exhilarating. Our hunch that there is a dire need for franchise information that is realistic and trustworthy has been proven right. The mailbox experts@whichfranchise.co.za has been inundated with queries and we have responded to them all, usually within 24 hours.
Through the medium of this newsletter, we aim to disseminate information of general interest to those of you who are considering the acquisition of a franchise. In addition to featuring news of general interest to the sector, we will provide commentary on topics of current concern. Given the high level of interest elicited by a Cape tax court judge's decision on royalty payments, and its possible effect on the franchise sector, we considered it appropriate to deal with this topic in our first edition. In future editions, we'll also feature hot new opportunities and keep you informed of franchise- related events.
It is our hope, however, that the content of this newsletter will ultimately be shaped by you. We invite you to ask questions and provide commentary on franchise-related issues that are of concern to you. No need to worry - we will continue to respond to every email personally and promptly. However, future editorials will revolve around the questions you ask, and the opinions you express, either in response to articles we carried or on a new issue you wish to raise. So, keep the emails rolling in!

Last year's landmark ruling by a Cape Tax Court, which agreed with SARS that royalty payments are capital in nature and therefore do not constitute a tax-deductible expense, continues to create waves in franchise circles. Although many experts believe that the learned judge erred in his findings and that SARS will lose its case if and when the matter goes on appeal, problems could arise in the interim. In any event, court decisions are notoriously unpredictable. Read more…

The International Franchise Exhibition, held at the Sandton Conference Centre earlier last month, attracted close on 10 000 visitors. This can be seen as proof supreme that franchising in South Africa is not merely ticking over but is in fact moving ahead with due speed. BEE initiatives provide additional impetus in this regard because a growing number of blue-chip companies recognise that franchising is a viable model for the implementation of sustainable BEE initiatives. It is clear, however, that male entrepreneurs continue to outnumber their female counterparts by a significant margin. Quite frankly, we are puzzled by that. Read more…
